Bristol Myers Squibb and Ono Pharmaceutical filed a Delaware federal lawsuit against Amgen to block its proposed U.S. biosimilar of Opdivo. The plaintiffs allege that Amgen’s biosimilar infringes multiple Opdivo-related patents. Opdivo generated more than $5.9 billion in U.S. revenue for Bristol Myers last year, and Bristol Myers expects patent exclusivity to continue through 2028. The plaintiffs are seeking to prevent Amgen from selling the biosimilar while the patents remain in force.
