Bristol Myers Squibb and Ono Pharmaceutical sued Amgen in Delaware federal court to block its proposed U.S. biosimilar of the cancer immunotherapy Opdivo. The plaintiffs allege that Amgen’s biosimilar infringes patents covering Opdivo, which generated more than $5.9 billion in U.S. revenue for Bristol Myers last year. Bristol Myers expects patent exclusivity for Opdivo to continue through 2028 and is seeking to prevent Amgen from selling the biosimilar while the patents remain in force.
