A Pennsylvania federal judge dismissed a lawsuit against Cigna, Evernorth, and Express Scripts brought by pharmacy customers over the designation of their community pharmacy as out-of-network. The court held that the state-law claims were preempted by federal benefits law. Plaintiffs were allowed to re-plead, so the litigation exposure is not necessarily resolved permanently.
