In February 2026, the U.S. Supreme Court held that tariffs imposed under the International Emergency Economic Powers Act on U.S. imports were unauthorized, while leaving unresolved whether previously collected duties can be refunded. The Utilities are evaluating whether refunds of IEEPA tariffs paid through third-party vendors are available. Although tariffs had not materially affected operations or financial condition through June 30, 2026, materials costs increased across supply-chain contract portfolios. Continued tariffs could raise material costs further and cause supply-chain disruptions, while the Companies cannot predict the effects of evolving tariff laws, litigation and implementation actions.
