The OCC and other intervenors have challenged PJM’s handling of Attachment M‑3 “Supplemental Projects,” alleging lack of PJM review for need, prudence and cost‑effectiveness and seeking new FERC oversight and independent monitoring. The complaint was expanded to include all PJM transmission utilities (including JCP&L) and FirstEnergy participated through PJM transmission owner consortiums and trade groups. FirstEnergy filed a motion to dismiss and the matter remains pending before FERC, and separate complaints by industrial customers seek to limit local transmission planning. FirstEnergy warns that if these complaints proceed, they could materially impact transmission capital investment strategy and how local transmission projects are planned and recovered.
