On August 4, 2026, the California Supreme Court ruled for Gilead Sciences in litigation involving HIV-drug patients. The court held that manufacturers of safe, nondefective drugs do not have a duty to innovate or develop potentially safer alternatives. The decision dismissed or otherwise resolved nearly 23,000–24,000 consolidated patient claims and rejects a liability theory that could have created substantial additional exposure for Gilead and other pharmaceutical companies.
