The FDA’s March 2020 final rule requires 11 textual cigarette warnings accompanied by color graphics depicting negative health consequences of smoking. In January 2025, the U.S. District Court for the Eastern District of Texas granted a preliminary injunction staying enforcement nationwide after finding that the FDA exceeded its statutory authority, and the FDA appealed to the Fifth Circuit in March 2025. Separately, in August 2025, a federal court in Georgia vacated the rule for failure to timely disclose data relied upon in its development; the FDA appealed to the Eleventh Circuit in October 2025. PM USA and other manufacturers also challenged the rule on First Amendment grounds, but the Supreme Court declined review in August 2024 after the Fifth Circuit reversed an earlier Texas decision.
