Multiple U.S. states and localities are considering or have enacted restrictions on tobacco products, including flavor bans, e-vapor certification requirements and nicotine caps. As of July 27, 2026, California, Massachusetts, New Jersey, New York, Rhode Island and Utah, plus the District of Columbia, had passed legislation banning flavors in one or more tobacco products; California’s law bans most flavored tobacco products, including menthol, mint and wintergreen. Indiana, Massachusetts and Utah capped nicotine levels in e-vapor products, with related legislation pending in one additional state. Such restrictions may limit product availability and adult smokers’ transition to smoke-free products, and could materially affect revenue, costs and the innovative nicotine businesses.
