FDA Tobacco Product Regulation

ALTRIA GROUP, INC. · 2026-10-29 · Importance 34 · Surprise 42 · In source text

In May 2026, the FDA issued guidance on enforcement for certain e-vapor and oral nicotine pouch products with pending PMTAs, generally deprioritizing enforcement for specified products undergoing scientific review or qualifying pending supplemental applications. The guidance preserves case-by-case enforcement and excludes, among others, products appealing to youth or presenting greater public-health or safety concerns. Public health organizations challenged the guidance in the U.S. District Court for the District of Maryland in July 2026, and Helix and NJOY moved to intervene in support of the FDA in October 2026.
