NIPSCO received successive 90-day emergency orders under Section 202(c) of the Federal Power Act to keep the R.M. Schahfer coal facility operating through September 19, 2026. The orders state that continued operation is required to address an energy emergency in MISO’s North and Central regions and authorize cost recovery under 16 U.S.C. § 824a(c). NIPSCO filed a complaint with FERC seeking a MISO tariff mechanism to recover and allocate compliance costs and made two related filings with the Indiana Utility Regulatory Commission. Revenues and operating costs associated with the facility are subject to recovery under the emergency-order tariff and return to customers.
