In May 2026, the U.S. Army Corps of Engineers issued a Record of Decision authorizing continued Dakota Access Pipeline operation under a new easement with enhanced safety and environmental conditions. Required measures include alternative water-supply planning, groundwater monitoring, biannual Lake Oahe surveillance, fish-tissue sampling after a release, eagle protection, independent leak-detection reviews, emergency food distribution planning and continued Tribal engagement. ETCO has no confirmed plans to transport Canadian crude through Lake Oahe before late 2028 or early 2029, and any such transportation would require regulatory and shipper approvals plus updated reports and oil-consumption documentation. The Standing Rock Sioux Tribe and affiliated environmental groups may challenge the decision in federal district court in Washington, D.C.; a shutdown could materially affect results and cash flows, including Phillips 66’s potential $215 million share of contingent equity contributions and approximately $10 million in annual interest support.
