In June 2024, the U.S. Supreme Court’s Loper Bright and Relentless decisions ended mandatory judicial deference to federal agencies’ interpretations of ambiguous statutes. UHS expects the decision could materially affect the highly regulated healthcare industry, including Medicare reimbursement, Food and Drug Administration decision-making, and healthcare fraud-and-abuse compliance. Parties may no longer be able to rely on federal agency policies, rules and guidance in those areas.
