A federal judge ruled that Lupin’s proposed generic versions of Vertex’s cystic fibrosis drug KALYDECO do not infringe four Vertex patents. The court found Vertex’s patent claims covering an “about 80%” active-ingredient concentration too vague and insufficiently defined. The ruling dismisses Vertex’s infringement lawsuit and increases competitive and market-access risk for KALYDECO if Lupin proceeds with its generic products.
